Unions Call for Political Answers<\/strong><\/em><\/h4>\n<p>&nbsp;<\/p>\n<p>Following our earlier publication, <strong>&#8220;<a href=\"https:\/\/unionsyndicale.eu\/en\/unions-demand-transparency-on-iter-staff-cuts\/\">Unions Demand Transparency on ITER Staff Cuts<\/a>&#8220;<\/strong>, staff trade unions continue to seek answers regarding the staff reduction measures adopted by the ITER Organization (IO) in July 2026.<\/p>\n<p>In August 2026, staff representatives raised serious concerns about the process followed by the ITER Organization, the impact of the measures on staff and programme delivery, and the absence of meaningful social dialogue. Subsequent exchanges with European Commission services have, however, left important questions unanswered regarding the role of Euratom and the European Commission within ITER&#8217;s governance structure, the legal and procedural assessment of the measures, and the accountability mechanisms applicable to a project that receives substantial EU funding.<\/p>\n<p>The unions have therefore addressed a new note to Commissioners <strong>Piotr Serafin<\/strong> and <strong>Dan J\u00f8rgensen<\/strong>, requesting political-level clarification on the position taken by the Commission within the ITER Council, the scrutiny applied to the amendments to the ITER Staff Regulations, and the Commission&#8217;s oversight responsibilities as both a key governance actor and the largest financial contributor to the project.<\/p>\n<p>The concerns raised go beyond the situation of the affected staff members. They touch upon broader questions of transparency, governance, accountability, social dialogue and stewardship of public funds within one of the European Union&#8217;s largest long-term scientific investments.<\/p>\n<p><em><strong>Previous Correspondence<\/strong><\/em><\/p>\n<p><strong>12 August 2026<\/strong><br \/>\nNote addressed to <strong>Pietro Barabaschi<\/strong>, Director-General of the ITER Organisation, and <strong>J. Leardini<\/strong> responding on behalf of Commission services.<\/p>\n<p><a href=\"https:\/\/unionsyndicale.eu\/wp-content\/uploads\/2026\/10\/Reply-ENER-HR-SG-to-TUSAs-ITER-Organisation-staff-reductions-\u2013-Request-for-a-social-dialogue-meeting.pdf\"><em><strong>&gt;&gt;<\/strong>\u00a0 Read the Commission services&#8217; reply of 25 September 2026<\/em><\/a><\/p>\n<p><em><strong>New Note to the Commissioners<\/strong><\/em><\/p>\n<p>Following the reply received from Commission services, staff trade unions consider that several key questions remain unanswered, including:<\/p>\n<ul>\n<li>The position taken by the Commission representative in the ITER Council when the staff reduction measures were discussed and approved;<\/li>\n<li>Whether legal, procedural or staff-policy concerns were raised during the decision-making process;<\/li>\n<li>Whether amendments to the ITER Staff Regulations were reviewed by DG HR, the Legal Service or other competent Commission services prior to adoption;<\/li>\n<li>Whether inter-service consultation took place before the Commission&#8217;s position was established;<\/li>\n<li>How the Commission reconciles its governance responsibilities with its stated inability to intervene in ITER&#8217;s internal staff-management decisions.<\/li>\n<\/ul>\n<p>The Unions have therefore requested clarification directly from the responsible Commissioners and reiterate their commitment to constructive dialogue. Panek, Head of the European Delegation to the ITER Council and Director for Nuclear Energy, Safety and ITER, raising serious concerns regarding the process followed, the implications for programme delivery, and the urgent need for meaningful social dialogue on the staff reductions decided by the ITER Organization (IO) in July 2026.<\/li>\n<li>Our note of 19 August 2026 to the attention of Mr S. Quest and Ms C. Gauer.<\/li>\n<li>Note of 25 September 2026 from Ms C. Gauer, Mr S. Quest and Mr P. Leardini addressed to us.<\/li>\n<\/ul>\n<p><span>We are writing to you further to the response referred to above, recently provided by the three Commission Directorates-General concerned, regarding the issues we raised in relation to the recent staff measures adopted within ITER.<\/span><span><\/span><\/p>\n<p><b><span>In our previous correspondence, we drew attention to a number of serious questions concerning the role and responsibilities of the European Commission and Euratom within the governance of ITER, particularly in light of Euratom\u2019s position as the ITER Member responsible for the largest share of the project\u2019s construction costs.<\/span><\/b><b><span><\/span><\/b><\/p>\n<p><span>We also recall again that President von der Leyen has consistently affirmed that representatives of the Commission serving within international or intergovernmental bodies are expected, in the exercise of their mandate, to act in accordance with the principles of the rule of law, sound administration, transparency and the social standards upheld by the European Union.<\/span><span><\/span><\/p>\n<p><span>These responsibilities must be considered in light of the scale of the Union\u2019s financial commitment to ITER. The Union has committed substantial budgetary resources to the project over successive Multiannual Financial Frameworks. For the 2021\u20132027 period alone, the maximum level of Euratom commitments for ITER was set at <b>EUR 5.614 billion in current prices<\/b>.<\/span><span><\/span><\/p>\n<p><span>Moreover, under the Commission\u2019s proposal for the 2028\u20132034 Multiannual Financial Framework, <b>a further EUR 5.794 billion in current prices is earmarked for ITER<\/b>.<\/span><span><\/span><\/p>\n<p><span>Commissioner Serafin has repeatedly underlined the difficulties surrounding the negotiations on the next MFF and the challenges involved in securing support for the Commission\u2019s budgetary proposals.<\/span><span><\/span><\/p>\n<p><b><span>In that context, we believe that the Commission\u2019s ability credibly to defend a further allocation of EUR 5.794 billion to ITER necessarily depends on its capacity to provide the budgetary authority and European taxpayers with credible assurances as to the governance, accountability and sound management of the project.<\/span><\/b><b><span><\/span><\/b><\/p>\n<p><span>This is precisely why the reply we have received is a matter of concern.<\/span><span><\/span><\/p>\n<p><span>After almost two months of internal consultations involving three Directorates-General, the substance of the answer appears to be that the Commission bears no meaningful responsibility and has no effective role in relation to, decisions concerning internal matters at ITER.<\/span><span><\/span><\/p>\n<p><b><span>Such a position raises an obvious question: if the Commission considers itself unable to exercise meaningful scrutiny over decisions taken within ITER\u2019s governance structures, how does it intend to provide the budgetary authority and European taxpayers with sufficient assurances regarding the governance and proper management of the additional EUR 5.794 billion which it is proposing to allocate to the project?<\/span><\/b><b><span><\/span><\/b><\/p>\n<p><span>Our concern is reinforced by the fact that the Commission\u2019s reply does not address the specific and very factual questions we had submitted.<\/span><span><\/span><\/p>\n<p><b><span>We still do not know what position was taken by the Commission- Euratom representative when the contested staff measures and the procedural circumstances surrounding them, were considered by the ITER Council.<\/span><\/b><b><span><\/span><\/b><\/p>\n<p><b><span>We do not know whether the Commission representative expressed concerns, opposed any element of the measures concerned, supported them or abstained.<\/span><\/b><b><span><\/span><\/b><\/p>\n<p><span>Nor have we received an answer as to whether the amendments to the ITER Staff Regulations were, as had reportedly been the practice in the past, <b>submitted to DG HR<\/b> or to other competent Commission services for prior legal assessment.<\/span><span><\/span><\/p>\n<p><span>We fully understand that these questions may be sensitive. Their sensitivity, however, cannot justify avoiding them.<\/span><span><\/span><\/p>\n<p><b><span>There is an important distinction between stating that the Commission does not manage ITER staff on a day-to-day basis and concluding from this that it bears no responsibility in this matter. It is more concerning still to decline to answer specific questions regarding the positions taken by the Commission\u2019s representative within the ITER Council when decisions of this nature are submitted to that body.<\/span><\/b><b><span><\/span><\/b><\/p>\n<p><span>Our questions concern precisely the latter issue.
