{"id":6159,"date":"2019-01-21T14:10:01","date_gmt":"2019-01-21T13:10:01","guid":{"rendered":"https:\/\/unionsyndicale.eu\/?p=6159"},"modified":"2023-12-28T14:23:30","modified_gmt":"2023-12-28T13:23:30","slug":"protection-of-personal-data","status":"publish","type":"post","link":"https:\/\/unionsyndicale.eu\/en\/protection-of-personal-data\/","title":{"rendered":"Protection of personal data"},"content":{"rendered":"<section class=\"l-section wpb_row height_auto\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_flex valign_top type_default stacking_default\"><div class=\"vc_col-sm-12 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"g-cols wpb_row via_flex valign_top type_default stacking_default\"><div class=\"vc_col-sm-2 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><\/div><\/div><\/div><div class=\"vc_col-sm-8 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column us_custom_432d3f53\"><div class=\"wpb_wrapper\"><p>Concerning protection of personal <a href=\"https:\/\/unionsyndicale.eu\/en\/?s=personal+data&amp;lang=en\">data<\/a>, related to the <a href=\"http:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=BF4915B5D4E17CB5289A0F649311DA1F?text=&amp;docid=209784&amp;pageIndex=0&amp;doclang=FR&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=7500889\" target=\"_blank\" rel=\"noopener noreferrer\">Case T-881\/16<\/a>, the administration is responsible for data breaches.<\/p>\n<p>The General Court has rendered an interesting judgement regarding the private data protection of EU staff.<\/p>\n<p>The Court underlined that any data breach allowing non qualified staff to have access to the personal file of a staff member renders the administration liable to pay moral compensation.<\/p>\n<p>The mere fact of not having adequately protected the personal file of a staff member is by definition an illegal act. The apologies by the head of administration are not sufficient to repair the damage caused. The administration can also not hide behind technical difficulties or human errors.<\/p>\n<p>A clear warning for our administrations: personal data protection is being enforced, also inside the EU institutions and bodies.<\/p>\n<p>Reminder, as a public service worker you have the <a href=\"https:\/\/ec.europa.eu\/info\/law\/law-topic\/data-protection\/reform\/rights-citizens\/my-rights\/what-are-my-rights_en\">right<\/a> to :<\/p>\n<ul>\n<li><strong>information<\/strong>\u00a0about the processing of your personal data;<\/li>\n<li><strong>obtain access to<\/strong>\u00a0the personal data held about you;<\/li>\n<li>ask for incorrect, inaccurate or incomplete personal data to be\u00a0<strong>corrected<\/strong>;<\/li>\n<li>request that personal\u00a0<strong>data be erased<\/strong>\u00a0when it\u2019s no longer needed or if processing it is unlawful;<\/li>\n<li><strong>object<\/strong>\u00a0to the processing of your personal data for marketing purposes or on grounds relating to your particular situation;<\/li>\n<li>request the\u00a0<strong>restriction\u00a0<\/strong>of the processing of your personal data in specific cases;<\/li>\n<li>receive your personal data in a machine-readable format and send it to another controller (\u2018<strong>data portability<\/strong>\u2019);<\/li>\n<li>request that decisions based on\u00a0<strong>automated processing<\/strong>\u00a0concerning you or significantly affecting you and based on your personal data are made by natural persons, not only by computers.
